I saw the Attorney-General with you today when Mr. Rees-Davies made the following statement which I took down in writing and read over to him and he accepted, after some verbal corrections, as accurately representing his views:-
*The Attorney-General informed me that during the 74 #months that he had acted as Chief Justice he had two exception- *-ally heavy cases one of which lasted 14 days and the other *54 days in the hearing only. During his tenure of office, there-
*-fore,
re, there would have been ample work for a Third Judge. But *in normal conditions he did not consider that, with a proper "allocation of work as between the Chief Justice and the Puisne *Judge, there was any necessity for a Third Judge except for "purposes of constituting a Court of Appeal which he has al-
"-ready reported as urgently required".

That is the opinion expressed by Mr. Ser -combe Smith, by Mr. Wise, till he a altered it when in 111- -health just before he left, and of Sir H. Berkeley and others including myself.
